PACA Law Faq's
PACA applies to any business involved in buying or selling perishable agricultural commodities in interstate or foreign commerce. This includes growers, shippers, distributors, wholesalers, and retailers.
To file a PACA claim, you must provide written notice to the buyer within 30 days of the payment due date, along with supporting documentation such as invoices and shipping records. If the buyer fails to respond or refuses to pay, you can file a formal complaint with the USDA's Agricultural Marketing Service.
If a buyer violates PACA by failing to pay for produce, they may be subject to a range of penalties including fines, license suspension or revocation, and legal action. Additionally, PACA provides for the establishment of a trust on behalf of produce sellers, which ensures that they are paid for their product even if the buyer becomes insolvent or bankrupt.
The USDA's Agricultural Marketing Service (AMS) is responsible for enforcing PACA and has the authority to investigate complaints, mediate disputes, and impose sanctions on violators. The AMS also maintains a PACA database, which provides access to information about PACA licensees and cases, and offers a range of resources and training programs to help industry participants understand and comply with PACA regulations.
